General terms and conditions of sale & internal rules

The general terms and conditions and the house rules form an integral part of the hotel contract and must be accepted before the sale is concluded. By requesting a reservation, you agree to be bound by these terms and conditions and accept them fully and without reservation. The rooms made available to our guests are checked, functional and in good condition.

ARTICLE 1 – Tariffs

The prices shown are in €uro and include VAT applicable on the day of booking. Any change in the applicable rate, or any modification or introduction of new legal taxes by the competent authorities, will be automatically reflected in the prices indicated on the invoice date.

Rates are per room for the number of people indicated and according to the period selected and do not include additional services (unless otherwise stated).

The daily tourist tax per adult is not included in the price and must be paid directly on site. Certain services may be subject to a supplement and to change without notice, for which the hotel cannot be held responsible.

No stay booked before the introduction of a promotional offer will be refunded, even partially.

ARTICLE 2 – Change and cancellation of stay

Any changes to or cancellations of bookings must be sent by email to lebellevue@gmail.com. The request will only become effective once Hôtel Bellevue Cap d’Agde has confirmed its acceptance in writing.

In the event of modification or cancellation of a stay, the following conditions apply (except in cases of force majeure):
– The cancellation conditions of the tariff chosen at the time of booking apply.
– In the event of a no-show on the scheduled arrival date, your credit card will be debited for the full amount of the stay booked.
– Any stay commenced must be paid in full.

For bookings made via our partners’ websites (e.g. Booking), cancellations must be made via this website.

ARTICLE 3 – Force majeur

Force majeure is any event outside the control of the parties that is both unforeseeable and insurmountable, and which prevents the customer from fulfilling all or part of the obligations set out in the contract. This applies in particular to strikes involving means of transport, hotel staff or government or public riots.

ARTICLE 4 – Hotel access

The hotelier is at liberty not to receive guests whose dress is indecent and negligent, and whose behaviour is noisy, improper, alcoholic or contrary to public decency and order.

Anyone wishing to stay at a hotel must identify themselves and any accompanying persons.

ARTICLE 5 – Opening hours

The hotel is open from 7.40am to 10pm (these times may change during the season).

ARTICLE 6 – Room occupancy

The guest may not bring into the room third parties not known to the hotelier, unless authorised by the latter. Similarly, the customer may not rent a room for more people than the number stipulated by the regulations in force.

ARTICLE 7 – Registration and services

On arrival, unless agreed by the hotelier, the guest may not require to occupy the room before 4pm.

The nightly rental period ends at 11.00 am and the keys must be returned at 11.00 am at the reception desk. If the keys are not returned at the specified time, a charge of €10 will be made for each hour’s delay.

Rented rooms are kept for 6 hours following the date and time of arrival (4pm to 10pm). Once this period has elapsed, the rental ceases to be held and the sum paid remains the property of the hotel. The balance of the stay must be paid at the hotel.

If you arrive after 9pm, please inform reception in advance. If you leave before 7am, extras must be paid for at reception by 10pm the day before.

For departures before 9am, payment must be made the day before, at reception, before 10pm.

The children’s breakfast rate applies to children up to and including the age of 10.

ARTICLE 8 – Key management

The room key is an electronic (or classic) key that guests can keep with them. However, it must not be entrusted to a third party and must be returned on the day of departure. In the event of non-return, the hotel will charge €15 and deduct the amount from the guest’s credit card.

ARTICLE 9 – Nuisances and respect for the rest of other customers

Noise, even during the day, is forbidden. Any guest causing disorder or scandal in any form whatsoever will be asked to leave the hotel immediately and without refund. In the interests of everyone and the peace and quiet of the establishment, all noise must cease between 10.00 pm and 8.00 am.

For the respect and rest of other guests, please do not slam doors or make too much noise, especially between 10.00 pm and 8.00 am. Any neighbourhood noise caused by a person’s behaviour may lead the hotelier to ask that person to leave the establishment without the need for acoustic measurements, provided that the noise generated is such as to disturb the peace and quiet of customers (art. R.1334-30 and R; 1334-31 of the Public Health Code).

A hotel room is a place to rest.

ARTICLE 10 – Responsibilities

The customer must use the leased property with due care. The rooms made available to our guests are checked, functional and in good condition. Children are the sole responsibility of the customer. It is forbidden to run, ride (bicycle, scooter, etc.) or shout on the premises, day or night.

Any pets accepted by the hotel are also the responsibility of the tenant. They must not be left unattended in the room. In the event of a problem, the customer must accept civil liability. In the event of damage, the hotel reserves the right to charge the customer for the cost of repair or replacement. The same applies to any offence recorded after the customer’s departure; the amount of compensation will be debited from the customer’s card.

In the event of deliberate or involuntary damage to equipment, objects or furniture belonging to the hotel, the hotel may demand full reimbursement with a penalty and damages of €1,000 to €2,000.

In the event of flooding or water damage, whether voluntary or involuntary, the hotel may demand full reimbursement for any damage caused. In the event of damage to other rooms, reimbursement will be demanded for the nights spent by other guests.

The hotel may charge a cleaning fee of €60 if the room is left in a condition deemed unsuitable. In the event of damage to or theft of bedding, bed bases, towels and furniture in the room and communal areas, the hotel will demand reimbursement of the damage, with a minimum charge of €1,500 for repairs and for the inability to re-let the rooms. As a general rule, customers must pay any damage caused directly to the hotel. They can call on their insurance (if they wish to be reimbursed) for any voluntary or involuntary damage they cause during their stay.

Any damage or nuisance caused intentionally or unintentionally must be paid for by the person who booked the room, as must any damage caused by their pet.

Failure to comply with the rules and regulations governing safety and hygiene, and any damage or negligence that could result in direct or indirect damage to equipment, people or future services, will incur your liability and will be invoiced.

You are responsible for the physical conditions in which you access the site, and we accept no liability for any effects resulting from the services provided. ARTICLE 12 – Relocation

If the Hôtel Bellevue Cap d’Agde is not available or in the event of force majeure, it reserves the right to accommodate the customer in whole or in part in a hotel, hotel residence or open-air establishment of equivalent or higher category, offering services of the same nature. The transfer will then be at the expense of the hotelier, who will not be entitled to claim any additional compensation.

ARTICLE 13 – Pets

Only small dogs are allowed on the premises and must be kept on a lead in the hotel. A daily fee will be charged. Guide dogs and assistance dogs are admitted free of charge with the prior agreement of the hotelier.

ARTICLE 14 – Parking

A car park is available for our customers (subject to availability, only one car per home will be accepted). People with reduced mobility have priority access to the car park. We accept no responsibility for lost, stolen or damaged vehicles in the hotel car park.

ARTICLE 15 – Restrictions

For safety reasons and out of respect for everyone, smoking is strictly prohibited in the hotel. In accordance with decree no. 2006-1386 of 15 November 2006 laying down the conditions for applying the ban on smoking in places designated for collective use, smoking in the hotel exposes you to an additional charge of €90 or to legal proceedings.

Any accidental activation of the fire alarm due to non-compliance with this provision will be billed at €150 to cover the cost of restarting the fire safety system. It is also forbidden to cook in the rooms, to take meals or drinks not provided by the hotel, or to do one’s own laundry.

It is also forbidden to store food in the room.

ARTICLE 16 – Data protection

In accordance with the French Data Protection Act 78-17, customers are hereby informed that their reservation is subject to computerised personal data processing. Users have the right to access and rectify the data entered, which can be exercised by contacting the head office:

Hôtel Bellevue offers Wi-Fi internet access. The user customer undertakes to ensure that the IT resources made available are not used in any way for the purposes of reproducing, representing, making available or communicating to the public works or objects protected by copyright or neighbouring rights, such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorisation is required.

ARTICLE 17 – Acceptance of the internal regulations and general terms and conditions of sale

The hotel’s house rules apply to all bookings. Any stay implies acceptance of the hotel’s special conditions and internal regulations. Failure to comply with the above provisions will result in immediate termination of the contract and financial penalties will be applied. In the event of non-compliance with the hotel’s internal regulations, the guest will be asked to leave the hotel without being able to claim any refund.

ARTICLE 18 – Complaints

All complaints must be sent to Hôtel Bellevue Cap d’Agde by recorded delivery letter with acknowledgement of receipt, within 15 days of the departure of the holiday that is the subject of the complaint. After this time, no claims will be accepted.

ARTICLE 19 – Applicable law

These general terms and conditions of sale are governed by French law. This applies to both substantive and formal rules. Any disputes will fall under the exclusive jurisdiction of the French courts.
